4. User Rights and Choices

Depending on your place of residence, you may have certain privacy rights under laws such as the California Privacy Rights Act (CPRA), Virginia Consumer Data Protection Act (VCDPA), Colorado Privacy Act (CPA), Connecticut Data Privacy Act (CTDPA), and the EU General Data Protection Regulation (GDPR). These rights may include the ability to:

  • Access, correct, or delete your personal information.
  • Opt out of the "sale" or "sharing" of personal information, including for targeted advertising.
  • Limit the use and disclosure of sensitive personal information.
  • Receive a portable copy of your personal information.
  • Withdraw consent where processing is based on consent.

We will respond to your request within the time period required by applicable law, and in certain jurisdictions, you may appeal a denied request by contacting us as described in Section 13. If you are located in the EU or UK, you also have the right to lodge a complaint with your local data protection authority.

You can manage your communication preferences, including category-level opt-outs and global unsubscribe, through our preference center. Even if you opt out of marketing communications, we may still send you transactional or administrative messages related to your membership, events, or services.

5. Data Sharing and Disclosure

We may share your information with:

  • Service providers who perform functions on our behalf, such as website hosting, marketing, analytics, event management, and payment processing.
  • Affiliates and partners for NAB-related activities, programs, and events.
  • Event exhibitors and sponsors when you allow your badge to be scanned or otherwise choose to interact with them. These parties may use the information for their own purposes, subject to their privacy policies.
  • Advocacy partners when you participate in campaigns.
  • Legal authorities or other third parties when required by law, regulation, or legal process, or to protect NAB’s rights and the rights of others.

All of our service providers are required to process personal information only under binding contracts that include confidentiality, security, and data deletion obligations.

We do not sell your personal information for monetary compensation. If we "share" personal information for targeted advertising as defined by certain state laws, we will provide an opt-out mechanism.

6. Data Retention

We retain personal information only as long as necessary to fulfill the purposes described in this Policy, to comply with legal obligations, to support archival needs, to serve legitimate business purposes, or as otherwise permitted by law.

When personal information is no longer needed for these purposes, NAB will securely delete, anonymize, or otherwise appropriately manage it.

7. Data Security

We use administrative, technical, and physical safeguards to protect personal information, including encryption, access controls, secure storage, and regular security reviews. These measures are designed to protect information both in transit and at rest.

While we work to protect your information, no system can be guaranteed to be 100% secure. In the event of a data breach, we will notify affected individuals as required by applicable law and take steps to mitigate potential harm.

8. Cookies and Other Technologies

A cookie is a piece of data stored on your hard drive containing non-personally identifiable information about you. NAB may use cookies and similar technologies to:

Collect certain technical details, such as IP address (e.g., whether you are logged on from a .com, .gov, or .edu domain), domain name, browser type, operating system, and device type.

  • Recognize your device when you revisit our website.
  • Recall authentication information so you can access member areas and event platforms without re-entering credentials.
  • Track statistical information about navigation and use, such as pages visited, links clicked, and time spent.
  • Remember your settings and preferences to enhance your experience.
  • Share limited cookie-derived information with contractors, service providers, and/or affiliates to operate, secure, and improve our Services.

NAB may collect this information in order to better operate our websites, enhance your experience while using our Services, and provide you with a more personalized visit, including through collaboration with contractors, affiliates, and service providers.

Some cookies are set by NAB ("first-party cookies"), while others may be placed by third-party service providers (for example, analytics tools or advertising partners). Cookies may be session-based (deleted when you close your browser) or persistent (stored until they expire or are deleted). These cookies generally fall into the following categories: necessary, functional, analytics, and advertising.

You can manage or disable cookies through your browser settings. Some cookies are essential for the operation of our Services and disabling them may affect your ability to use certain features. In jurisdictions where required, we will seek your prior consent before placing non-essential cookies (such as analytics or advertising cookies).

9. Children's Privacy

Our Services are not directed to minors under the age of 16, and we do not knowingly collect personal information from them. If we become aware that we have collected such information, we will delete it promptly. If you believe a minor has provided us with personal information, please contact us at privacy@nab.org.

10. Legal Compliance

We process and protect personal information in accordance with applicable privacy and data protection laws, such as the California Privacy Rights Act (CPRA), Virginia Consumer Data Protection Act (VCDPA), Colorado Privacy Act (CPA), Connecticut Data Privacy Act (CTDPA), the European Union General Data Protection Regulation (GDPR), and other U.S. federal and state laws.

We collect, use, and share personal information only when we have a lawful basis to do so, such as your consent, the performance of a contract, compliance with legal obligations, or our legitimate interests where those interests are not outweighed by your privacy rights.

We may disclose personal information when required to do so by law, regulation, or legal process, or when we believe such disclosure is necessary to protect the rights, property, or safety of NAB, our members, or others.

If we transfer personal information outside of the country in which it was collected, we do so in accordance with applicable law, using approved transfer mechanisms.

11. Third-Party Links and Services

Our Services may link to or integrate with third-party websites, applications, or services. This Privacy Policy applies only to NAB-controlled websites and platforms. We are not responsible for the privacy, security, or data practices of these third parties, and your use of their services is governed by their own privacy policies.

12. Policy Updates

We may update this Privacy Policy from time to time. Material changes will be communicated via email or a prominent notice on our Services. The "Last Updated" date at the top of this Policy reflects the latest changes. Unless otherwise stated, changes will take effect when posted. Your continued use of our Services after the effective date will signify your acceptance of the updated Policy.
