On April 23, the Federal Trade Commission (FTC) voted on a final rule banning most noncompete provisions in employment contracts. The rule is set to go into effect on September 4, 2024.
How does the rule affect broadcasters? As of the effective date, broadcasters will be prohibited from entering into noncompete agreements with their employees. Broadcasters also may not enforce existing noncompete agreements with employees, except for “senior executives.” The rule also requires employers to notify employees that their noncompetes are unenforceable by the effective date.
🖥️ Learn more: On May 14 at 11 a.m. ET, the FTC will host an online webinar that will provide an overview of the rule and information on how to comply with the rule after its effective date.
What’s next? The U.S. Chamber of Commerce and others have filed lawsuits in federal court challenging the FTC’s authority to issue the rule. The Chamber has also sought an order delaying the effective date of the final rule pending resolution of the litigation.
Stay tuned: NAB will continue to monitor the legal challenges and their impact on the effective date of the rule in the coming months.
