5. FCC Reinstates Form 395-B
Last week, the FCC reinstated Form 395-B, which collects data on the workforce composition of television and radio broadcasters. The form collects race, ethnicity and gender information about a broadcaster’s employees within specified job categories.
Why it’s happening: The FCC concluded that it has a public interest in restoring Form 395-B in order to report on and analyze employment trends in the broadcast sector and to compare trends across other sectors regulated by the FCC.
The FCC found that collecting the Form 395-B data in a publicly available format is the best approach for achieving its goal of preparing meaningful and accurate analyses of workforce trends in the broadcast industry. The FCC stated that public disclosure of the data will increase the likelihood that mistakes are discovered and corrected and maximize the usefulness of the data.
In response to concerns that the data may be used by third parties to pressure stations to hire based on race or gender, the FCC reiterated its previous commitment to quickly dismiss any petition, complaint or other filing based on Form 395-B employment data.
The FCC also repeated its standing policy that it will not use station specific employment data for the purpose of assessing a broadcast licensee’s compliance with the EEO regulations and will clarify its rules to underscore the dissociation between the EEO requirements and the form’s data.
Broadcasters will be required to submit the form by September 30 of each year once the FCC’s order becomes effective. The FCC will provide instructions on how to file before the first deadline for filing.
The FCC also asked for comment on reinstating Form 395-A, which collects similar data from multichannel video programming distributors.
