The Copyright Office has published the National Association of Broadcasters' (NAB) streaming agreement with SoundExchange, and the rates and terms specified in the agreement are now available to broadcasters.
Broadcasters who are currently streaming:
For those who are currently streaming and wish to elect these rates, there is a deadline of 30 days to do so (no later than April 2, 2009). Click here to access the summary of the rates and terms. The new rate schedule covers the years 2009 through 2015. Consult your station attorney for guidance.
Broadcasters who are not currently streaming:
The negotiated rates and terms will continue to be available for broadcasters who are not currently streaming. In order to opt in to the negotiated rates and terms, a broadcaster must complete the election form on the SoundExchange Web site within the first 30 days of initial streaming. Notice of Use and other requirements must be followed. Consult your station attorney for guidance.
Option to participate:
The negotiated rates and terms are available as an option for broadcasters. Those who opt not to elect the rates available under the agreement should continue to rely on the existing Copyright Royalty Board (CRB) rates through 2010, which will be reestablished for 2011 through 2015.
